Contest – Watch out for online fraud



The Protect Yourself from Online Fraud contest (the “contest”) begins on December 3, 2017 at 12:01 a.m. Eastern Standard Time (“EST”) and ends on December 17, 2017 at 11:59 p.m., EST (the “contest period”).


The contest is organized by Cogeco Connexion Inc. (“Cogeco”). It is open to residents of the province of Ontario who are Cogeco clients subscribed to the Cogeco Security GO Premium service and who have reached the age of majority in their province or territory of residence at the time of participation. The following persons are ineligible: employees, representatives or agents (and people with whom they are domiciled, whether related or not) of Cogeco Connexion Inc. (the “sponsor”), and of its parent company, subsidiaries, affiliated companies, suppliers of prizes, publicity and advertising agencies, and of any entity involved in the development, production, implementation, administration, prizes or operation of the contest (collectively referred to as the “parties to the contest”).

To be eligible, your entry must be sent and received within the terms of the present rules during the contest period. All eligible entries received within the terms of these rules during the contest period will be entered in the random draw.


There is a limit of one (1) entry per person during the contest period. For greater clarity and to avoid any misunderstanding, you are allowed to use one (1) Facebook account to enter the contest. If the sponsor discovers (by means of any proof or information it may receive or find) that a person has attempted: (i) to enter more than one (1) time; or (ii) to use multiple names, identities, email addresses or any automated or robotic system, macro, script or any other computer program to enter the contest or to disrupt its operation, that person may be disqualified from the contest at the sponsor’s sole discretion. Your entry may be rejected (at the sponsor’s sole discretion) if it does not include all required information or if it is not submitted and received within the terms of the present rules during the contest period. The releasees (defined below) are not responsible for late, lost, misaddressed, delayed, incomplete or incompatible entries (which will be considered null and void).


All entries are subject to verification at any time and for any reason. The sponsor reserves the right, at its sole discretion, to require proof of identity or eligibility (in a form acceptable to the sponsor, such as official photo ID) for the following purposes: (i) to confirm a person’s eligibility to enter the contest, (ii) to confirm the eligibility or legitimacy of an entry (or presumed entry) in the contest, or (iii) for any other reason deemed valid by the sponsor and at its sole discretion, for purposes of operating the contest in compliance with the present rules. Failure to provide such proof to the full satisfaction of the sponsor, by the date specified by the sponsor, may result in disqualification, at the sponsor’s sole discretion. The contest computer server(s) shall be the sole method used to determine the date and time for purposes of this contest.


There is one (1) prize to be won, consisting of 1 Amazon gift card valued at $50 (the “prize”). The prize must be accepted as-is and is not transferrable, assignable or convertible to cash (except in cases expressly authorized by the sponsor, at its sole discretion). No substitution will be provided, except at the sponsor’s discretion. The sponsor reserves the right, at its sole discretion, to replace the prize or a component thereof with another prize of equal or greater value, including, without limitation and at the sponsor’s exclusive discretion, a cash prize.


On December 18, 2017 (the “draw date”) in Montreal, Quebec, at approximately 3 p.m. EST, one (1) eligible entry will be chosen at random from among all eligible entries received during the contest period that meet the terms of the present rules. The odds of winning will depend on the number of eligible entries received within the terms of these rules during the contest period.


The sponsor or its designated representative will make a minimum of two (2) attempts to contact the selected participant (once by message within the Facebook discussion in the Facebook post for the contest [URL] and once via private Facebook message if the participant’s Facebook privacy settings allow it, one (1) business day after the draw. If the participant chosen through the draw cannot be reached within two (2) business days following the draw, or if a notice sent to the winner is returned to the sender, the sponsor may, at its sole discretion, disqualify the entry (in which case the participant will lose all rights to the prize) and the sponsor reserves the right, at its sole discretion and if there is sufficient time, to randomly select another eligible entry from among the eligible entries received, within the terms of these rules and during the contest period (to which the preceding terms of the present paragraph shall also apply).


Before being declared the confirmed winner of the prize, the selected participant must: (a) answer a mathematical skill testing question without mechanical or other assistance (the question may be asked, at the sponsor’s discretion, online, by email or by other electronic means, by telephone or on the sponsor’s declaration and waiver form); and (b) sign and return, within ten (10) business days of notice, the sponsor’s declaration and waiver form, which indicates among other things that the participant: (i) confirms their acceptance of the present rules; (ii) confirms their acceptance of the prize as awarded; (iii) releases the parties to the contest and Cogeco Connexion Inc., as well as their respective managers, directors, employees, representatives, related entities, divisions, successors and assigns (collectively, the “releasees”) from any liability whatsoever resulting from the winner’s participation in the contest or from the winner’s receipt, use or misuse of the prize or a portion thereof; and (iv) agrees to the publication, reproduction and use of their name, address, voice, statements about the contest, as well as photograph or likeness, without further compensation, in any advertisement or publicity issued by the sponsor in any manner whatsoever, including print and television media as well as the Internet. If the selected participant: (a) does not answer the skill-testing question correctly; (b) does not return the contest documents, duly signed, within the specified time; (c) cannot accept or refuses to accept the prize as awarded for any reason; or (d) proves to be in violation of the present rules (as determined by the sponsor at its sole discretion), the winner may, at the sponsor’s sole discretion, be disqualified (in which case the winner shall lose all rights to the prize), and the sponsor reserves the right, at its entire discretion and if there is sufficient time, to randomly select another eligible entry from among the remaining eligible entries submitted and received within the terms of the present rules (and the preceding terms in the present paragraph shall apply to the newly selected winner).


All entries become the property of the sponsor. The contest is governed by all applicable federal, provincial and local laws. The sponsor’s decisions affecting all aspects of the present contest are binding on all participants and are final and not subject to appeal, including, among other things, decisions related to the eligibility and disqualification of an entry or a participant. By entering the contest, you agree to be legally bound by the terms of the present rules. ANY PERSON DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THESE RULES FOR ANY REASON WHATSOEVER MAY BE DISQUALIFIED AT ANY TIME, AT THE SPONSOR’S SOLE DISCRETION.

The releasees assume no liability for: (i) any website service outage during the contest; (ii) any technical defect or other problem of any nature including those related to telephone networks or lines, online computer systems, servers, internet service providers, computer equipment or software; (iii) the failure to record an entry or other information received, entered or recorded for any reason whatsoever, including technical problems or outages affecting the internet or any website; (iv) any prejudice or damage caused to a computer or other device belonging to a participant or to any other person having a connection with participation in the contest; and (v) any combination of the preceding elements.

In case of a dispute concerning the identity of the person who entered, the sponsor reserves the right, at its sole discretion, to deem that the entry was made by the authorized owner of the electronic account used for entering the contest. The “authorized account holder” is defined as the person assigned an email address by an internet service provider, the provider of an online service or another organization (or company or educational institution, for example) responsible for assigning email addresses for the domain associated with the email address submitted. A participant may be asked to prove (by means acceptable to the sponsor, such as an official photo ID), that the participant is the authorized owner of the electronic address associated with the contest entry in question.

The sponsor reserves the right to withdraw, modify or suspend the present contest (or to modify the present rules) in any manner whatsoever, in the event of a cause independent of the reasonable desire of the sponsor that would compromise the effective operation of the present contest as envisaged by these rules, including an error, technical problem, computer virus, bug, modification, unauthorized activity, fraud or technical deficiency of any nature whatsoever. Any attempt to intentionally damage a website or interfere with the legitimate operation of the contest in any manner whatsoever (as determined by the sponsor at its entire and absolute discretion) constitutes a violation of civil and criminal law. In such cases, the sponsor reserves the right to sue for damages and interest within the limits prescribed by law. The sponsor, conditional upon the consent of the Régie, reserves the right to cancel or suspend the Contest or to modify its Rules, in the event of an accident or mistake in printing or administration, or another error of any kind, without notice or obligation. Without limiting the general applicability of the foregoing, the sponsor reserves the right, at its discretion, to administer a different skill test that it deems appropriate based on the circumstances or in order to comply with applicable laws.

By entering this contest, each participant expressly agrees that the sponsor, its employees and representatives may share personal information submitted with contest entries solely for purposes of administering the contest, in compliance with the sponsor’s privacy policy (available here: The present section does not limit any other consent that a person may provide to the sponsor or other parties relating to the collection, use or disclosure of their personal information.

The sponsor reserves the right to modify any date or deadline stipulated in these rules, or any other contest term, to the extent deemed necessary to confirm the compliance of a participant or an entry with the present rules, or following technical or other problems, or in light of any other circumstance that, in the sponsor’s judgment, at its sole discretion, affects the proper operation of the contest according to the terms of the present rules, or for any other reason.

In case of any discrepancy or conflict between the English version of the present rules and any other disclosures or other statements made in other materials related to the contest, including, without limitation, the entry form, website, French version of these rules, point-of-sale displays, television, print or online media coverage, the clauses of the English version of the rules shall take precedence to the extent permitted by applicable laws.
